Booking Policy

Responsibility
Your trip will be arranged by PT. Indsight Destination Managemen (“mytripology”) acting only as agents for the hotels and other places of accommodation, tour companies, airlines and air charter companies, vehicle companies, railroads, ship lines, or other suppliers of services connected with mytripology (“Other Providers” or “Supplier”), providing accommodations, touring, transportation or other services included in your trip.
mytripology does not own or operate any entity which is to or does provide goods or services for your trip. All such entities are independent contractors. As a result, mytripology cannot be liable for any negligent or willful act of any such entity, their employees or agents or of any third person. The Other Providers are solely responsible and liable for providing their respective services.
The passenger tickets in use by the carriers shall constitute the sole contract between the carriers and the passenger; All vouchers, coupons, exchange orders, receipts, contracts and tickets issued by mytripology are issued subject to any and all tariffs, terms and conditions under which any such accommodations, sightseeing, transportation or other services are provided by our Suppliers. The carriers are not responsible for any act, omission, or event during the time participants are not aboard their conveyances.
mytripology can accept no responsibility or liability for passenger health or safety. By registering for a trip b, the participant certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for himself or herself or other participants. mytripology reserve the right in their sole discretion to accept, decline to accept, or remove any participant on a trip. mytripology reserve the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of participants. All participants should be prepared for unexpected changes in the itinerary and should arrive with a flexible attitude toward their visit and with the understanding that it is impossible to control, foresee, or guarantee all aspects of the tour. Comprehensive travel insurance (including trip delay, trip cancellation, trip interruption, and baggage) and health, accident and medical evacuation insurance are strongly recommended.
mytripology, its employees, subsidiaries, affiliates, officers, directors, successors, representatives, assigns (collectively “mytripology”) shall not be held liable for:
any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any Other Provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such Other Provider; and
any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, allergic reactions, quarantine, epidemics, medical or customs regulations, theft, or any other cause(s) beyond their control.
loss or damage to baggage, financial defaults of service providers, delays or cancellations of or changes in itinerary or schedules, or from any other causes beyond the control of mytripology including, without limitation, any act of negligence or breach of contract by any independent third party who is to or does supply any goods or services for your trip, or for any loss or damage resulting from insufficient or improperly issued passports, visas or other documents, and that neither mytripology nor any of their agents shall be or become liable or responsible for any additional expenses or liability sustained or incurred by you as a result of any of the foregoing causes. The participant waives any claim against mytripology for any such loss, damage, injury, or death.
The services provided by our Suppliers are subject to the laws of the place where the services are provided and any conditions imposed by those Suppliers. The liability of the Suppliers may be limited by their tariffs, conditions of carriage, tickets and vouchers, and international conventions and agreements. Payment of any tour fees shall constitute consent to all provisions of this Agreement as set forth herein.
Terms and Conditions
Duration
This agreement commences on the date we accept your application form or the date your place a booking through us (whichever occurs sooner) and shall continue for the duration of time we provide travel services to you. This agreement is non-exclusive.
Tour Costs And Inclusions
All tour costs are based upon the specified services in your customized itinerary as per the “What’s Included” section. Tour costs generally include accommodations; private sightseeing with guide, English-speaking guides and/or English-speaking drivers as specified in the itinerary; admission fees (unless otherwise specified); meals as indicated in detailed itinerary (B=breakfast, L=lunch, D=dinner); accommodation taxes and service charges; transportation; internal flights (if specified as included); airport, train station and/or port transfers as specified; government fees and local handling charges; the full services of mytripology before, during and after your trip; pre-trip travel documents. Itemized cost breakdowns are not available. Please refer to the “What’s Included” section of your personalized itinerary for detailed information regarding which services are included in your tour cost.
All tour costs are quoted in USD ($). Other currencies such as EUR (€), IDR (Rp), and Pound sterling (£) can also be quoted by request.
Quoted tour prices include extensive personalized planning and operational charges, and are based on current rates of exchange, airfares, tariffs and taxes as of the date of issuance of your itinerary. Prices are valid for the travel dates specified in your confirmed itinerary. mytripology reserves the right to increase tour prices to cover increased costs, airfares, tariffs and taxes, and to reflect fluctuations in foreign exchange markets. Prices are based on the number of travelers in your party; additions to or withdrawals from the group may alter the price for each participant. The notification will be given at the time of final invoicing.
Items Not Included
Unless otherwise specified in your detailed itinerary, airport departure taxes, gratuities (tipping guidelines vary by destination and will be provided in travel documents), visa fees for visas obtained on arrival, travel insurance, tours indicated as optional or not specified in the itinerary, medical expenses and immunizations , items of a personal nature or personal expenses, such as laundry, telephone calls, alcoholic beverages, excess baggage charges and any items not specifically listed as included, are not included.
Reservations, Deposits and Payments
Reservations may be made by contacting mytripology. A deposit of 20% of the full amount is required upon confirmation of services, with the balance to be paid not later than 45 (forty five) days prior to commencement of the services. Should bookings be made less than 45 (forty five) days prior to the tour start date in which case full payment is required immediately. All services and payments are non-transferrable. Payments may be made by wire transfer, PayPal, and credit card.
Cancellations and Refunds
If you or anyone on the booking has decided to cancel the holiday, the lead name must notify us on the decision as soon as possible. Any cancellation must be confirmed in writing or by email within 24 hours by the lead name. Cancellation will take effect from the day we are notified; provided that written confirmation is received by us within 24 hours of the original notification. A cancellation invoice will be sent to you within 7 days. If you do not receive this, please contact us immediately in order to prevent an increase in charges.
Cancellations are subject to the following penalties of the full trip price:
30% non-refundable deposit due at the time of confirmation.
46-60 days prior to arrival: 75% penalty
45 days or less prior to arrival: 100% penalty
Note: Certain tour destinations, or tours booked during peak travel dates, require additional advance deposits and/or have different payment terms and conditions. In such cases, the additional deposit amounts and related payment terms and conditions will be advised once required.
Cancellation fees may vary for certain custom itinerary tours; your Travel Designer will specify cancellation fees prior to making your reservation.
Cancellation penalties and fees imposed by our Suppliers may be additional and, if imposed, will be deducted from the above refunds, if any. No refunds will be made after commencement of your tour, whether for early termination, voluntary absence from the tour or for any unused services. Your decision not to travel due to State Department warnings, fear of travel, illness, or any other reason, will be deemed a cancellation. If a flight or other delay for any reason causes you to miss services, no refunds will be given. A change of trip date or change of travel destination(s) will be treated as a cancellation and cancellation fees will apply. Comprehensive travel insurance (including trip delay, trip cancellation, trip interruption, and baggage) and health, accident and medical evacuation insurance are strongly recommended.
Transportation
All air fares are subject to restrictions, cancellation penalties, change fees, and general airline policies and may change without notice. Certain airfares are subject to airline administration fees. Internal air arrangements are confirmed on commercial or scheduled flights, unless otherwise specified; requests for private charters must be made directly with mytripology. Should you cancel or change your air reservation once flights have been ticketed, cancellation and change fees may apply. Air, seat and meal requests are the sole responsibility of the Traveler. We cannot be held responsible for aircraft or seat assignment changes made by the airline. Note that regional flights overseas often will not accept advance seat or meal requests. Participants are responsible for providing mytripology with official (airline issued), complete and up-to-date international flight details. Ground transportation is provided by air-conditioned vehicles, unless otherwise specified.
Accommodations
Accommodation classification is based on a combination of factors including price, location and quality. In remote areas accommodation may be provided on a best available basis. Prices are based on double occupancy rooms with private bath facilities, unless otherwise requested or stated. Note that in many countries king beds and non-smoking rooms are not available. mytripology reserves the right to substitute comparable accommodations without notice.
Documentation
Participants are responsible for obtaining any documents required for their participation in the trip such as a valid passport, all visas, vaccination certificates, and any other documents. Failure to obtain documents does notnegate the terms and conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the participant’s responsibility.
Passports and Visas
All tour participants must be in possession of a passport valid for 6 (six) months from their date of arrival in any foreign country. For some tours, you will also need to have multiple consecutive blank visa pages within your passport (the number varies depending on the destination(s)). It is the sole responsibility of the tour participant to secure a valid passport with sufficient blank pages for immigration and visa stamps.
Although mytripology cannot be responsible for visas unless a specific arrangement is made, we are happy to assist you in providing necessary information on your tourist visas. Please let us know if you need help with relevant information about your tourist visas.
Baggage
All baggage is transported at owner's own risk. Please check directly with the airline for specific baggage allowances. mytripology arrangements and tour costs are based on one suitcase and one carry-on bag per traveler. If you anticipate that your luggage will exceed this amount, please contact us as soon as possible so that we can arrange larger vehicles for airport transfers and sightseeing accordingly. All money, valuables and travel documents should be packed in a carry-on bag for which you are responsible at all times. mytripology cannot be responsible for loss or damage to baggage. Insurance is strongly recommended.
Health and Physical Condition
Participants are understood to be in sufficient good health to undertake foreign travel. mytripology requests that all travelers notify us in writing as early as possible of any physical or health conditions or other special needs while traveling (e.g., wheel chair requirements, access to refrigerators to store medications, dietary requirements or allergies, requests for large seats, limited walking ability during touring, schedule requirements, etc.). We make this request to ensure that your comfort and convenience are taken into consideration for all travel services we arrange. We will make reasonable efforts to accommodate the needs of our travelers. In cases where we cannot accommodate a Traveler’s special needs, persons requiring this assistance must be accompanied by a companion who will be responsible for independently providing the needed assistance. Unless specific arrangements have been confirmed with mytripology, in no instance will we or our Suppliers physically push wheelchairs or lift or assist participants onto or off of transportation vehicles.
Medical Costs and Insurance
mytripology strongly recommends that, before traveling, you review your health and other insurance to ensure you have coverage appropriate to meet your needs, and those of your family and dependents, in case of any personal injury or loss of property. We also recommend consulting with your doctor 6 (six) to 8 (eight) weeks prior to your trip for advice on travel medications and recommended prophylaxis and vaccinations. Travelers are responsible for verifying all health conditions at each travel destination. Furthermore, mytripology strongly recommends the purchase of comprehensive travel insurance and medical evacuation coverage. Any questions about what travel insurance does or does not cover should be addressed directly to the travel insurance company. Travel insurance, medical evacuation and hospitalization costs are not included in the tour price.
Itinerary Changes
The itineraries and staff presented in mytripology documentation are subject to modification and change by mytripology. Every reasonable effort will be made to operate programs as planned, but alterations may still occur after final itineraries are sent.
Alterations of Arrangements
Voluntary changes made by tour participants after the itinerary has been finalized will be subject to an addition costs required for the changes, if any. Spelling corrections to participant names after air tickets have been issued are subject to airline revision fees. Should events beyond our control require it, mytripology reserves the right to alter or modify the itinerary without advance notice, to withdraw any tour component from your trip and/or to substitute a tour component of equal standard. Any costs resulting from such modifications shall be the responsibility of the tour participants. If any trip has to be delayed due to bad weather, travel conditions, flooding, flight or other transportation delays, over booking, government intervention, acts of war, acts of terrorism, sickness or any other contingency beyond the control of mytripology, the additional costs of the delays and rerouting will not be included and will be the responsibility of the tour participant. If, for reasons beyond our control, a tour in progress must be interrupted or cancelled, we will, in good faith, consider refunding a portion of the price, depending on our actual costs incurred, compared to the tour in your itinerary.
Dispute Resolution
If the participant has a complaint, he or she should first inform us or local guide while on the trip so we or local guide can attempt to rectify the matter. If the participant is still dissatisfied, he/she should submit the complaint in writing to mytripology 30 (thirty) days after the tour ends, and to file any suit within one year of the incident, you acknowledge that this expressly limits the applicable statute of limitations to 1 (one) year.
Any controversy or claim arising out of or relating to this Agreement, brochures, or any other literature concerning this tour, or the breach thereof, including without limitation any claim related to illness, injury, or death, shall be subject to the following conditions: 1) the dispute will be governed by Indonesian law; 2) the parties agree that they will attempt in good faith to settle any and all disputes arising out of, under or in connection with this Agreement, including without limitation the validity, interpretation, performance and breach hereof, through a process of mediation in Indonesia under the supervision of a mutually agreed upon mediator; 3) in the event that mediation fails to settle such a dispute, the parties agree that they will proceed under the arbitration rules of Indonesia National Board of Arbitration (BANI); 4) the maximum amount of recovery to which a participant will be entitled under any and all circumstances, will be limited to the amount paid to mytripology for its services. This agreement to arbitrate does not waive or modify any liability release agreed by the participant
Severability
If any provision of this Agreement is held to be invalid or unenforceable, all other provisions hereof shall nevertheless continue in full force and effect.
Modification And Waiver
The parties acknowledge that this Agreement shall not be subject to change or modification except by the execution of another instrument in writing, subscribed to by the parties hereto.
Governing Law
The laws of the Republic of Indonesia shall govern the validity, interpretation and implementation of this Agreement.
Entire Agreement
The foregoing contains the entire agreement between the parties, and there are no other understandings or agreements (other than the Arbitration Agreement) between them.
